BULGARIAN STANDARDS AND STANDARDIZATION DOCUMENTS

Contribution to the standards development

Contributions made by the representatives and experts in the BDS technical bodies in the development of Bulgarian standards and related documents shall only be accepted for inclusion in standard on strictly defined conditions. According to that all rights of copyright on the material and texts contributed for the purpose of the standard shall be fully vested in BDS and/or the International and European Standardization Organizations, as the case may be, who will be exclusively responsible for taking the necessary actions for protection the copyright so assigned. The representatives and experts in the BDS technical bodies shall confirm their agreement to make such assignments to BDS and/or the international and European Standardization Organizations in the required manner.

NOTE: Where contribution made by representatives and experts in the BDS technical bodies are included in a standard, in whole or in part, the contributor retains the right which they had to exploit such contributions for their/its own purposes.

COPYRIGHTS

Pursuant to the Law on National Standardization, Art. 52, 53 and 54 (Published in State Gazette, No. 88/04.11.2005 effective 05.05.2006, supplemented, SG No. 42/05.06.2009, amended, SG No. 97/10.12.2010, effective 10.12.2012, amended SG No. 82/26.10.2012 amended SG No. 7/19.01.2018, amended SG No. 103/13.12.2018 effective 01.01.2019, amended SG No. 14/17.02.2021 effective 17.02.2021) the Bulgarian Institute for Standardization shall be the holder of the copyright in Bulgarian standards and Bulgarian standardization documents and shall have the exclusive right to publish, reproduce, distribute and sell them.

The use of Bulgarian standards and standardization documents is subject to user’s acceptance of BDS terms on the use of Bulgarian standards and standardization documents and copyrights.
The user shall not copy, reproduce, publish, transfer to another server or send by mail, transmit or distribute in any other, unspecified up here manner any part of a Bulgarian standard or Bulgarian standardization document without BDS written permission.

The user shall be obliged to take all necessary actions to prevent access to BDS standards by unauthorized third parties.

In case of BDS copyright infringement the infringer shall be subject to civil and administrative - criminal liability pursuant to the Law on Copyright and Neighboring Rights, including pecuniary compensation for incurred damages and missed opportunities.

EUROPEAN STANDARDS AND STANDARDIZATION DOCUMENTS

In the framework of the Berne Convention, the CEN/CENELEC national members shall ensure that the exploitation rights in contributions to European Standardization made by themselves, their delegates in Technical Committees/Subcommittees and their experts in Working Groups are assigned to CEN/CENELEC for the benefit of its members. The CEN-CENELEC Management Centre is responsible for ensuring that the same conditions apply to other contributors to European standardization. The CEN/CENELEC national members and the CEN-CENELEC Management Centre shall establish a process in support of this obligation.

However, it is recognized that the original copyright holder is not precluded from continuing to exploit his own contribution for his own purposes provided that such exploitation does not adversely affect the exploitation of the common work.

The exploitation rights assigned free of charge worldwide to CEN/CENELEC cover all languages and cover all forms of exploitation known at present in particular and non-restrictively: reproduction and publication by all means and via all graphical support systems by print, press, photocopy, microfilms, and via all magnetic, computerized and numerical support systems, memory cards, CD-ROMs, films, photographs, slides, teledistribution, cable, satellite, diskettes and on-line document servers. This assignment is governed by Belgian law.

CEN/CENELEC assumes the protection, defence and legal responsibility for the copyright in CEN/CENELEC publications.

CEN/CENELEC grants exclusively and in totality to its members the assigned exploitation rights for the purpose of publishing, reproducing and distributing by any means the CEN/CENELEC publications in accordance with appropriate agreements.

The use of ISO Publications and national adoptions of ISO Publications is subject to the user's acceptance of ISO's terms of use and conditions of copyright for ISO publications, as set out below.

All ISO Publications and national adoptions thereof are protected by copyright. Therefore and unless otherwise specified, no part of an ISO Publication or a national adoption thereof may be reproduced or utilized in any form or by any means, electronic or mechanical, including photocopying, microfilm, scanning, without permission in writing from the publisher.
